DATA DISCLAIMER AND TERMS OF USE

ACCEPTANCE OF THESE TERMS

Data, datasets, records, and reports (the data) made available on or extracted from the website or Public Data Portal of the Los Angeles City Ethics Commission (Ethics Commission) are public data and are provided by the Ethics Commission as a public service, to enhance open government, transparency, and accountability. If you view, download, transfer, or otherwise access or use the data, these Terms of Use apply to you and to any transferee, vendee, or other end user of yours (collectively, users). If you transfer to or use the data in connection with any user in a format or context revealing the Ethics Commission as the source of the data, you agree to inform the user, by copy of these Terms of Use, that the Ethics Commission and the City of Los Angeles do not warrant the data in any way and make each of the disclaimers below.

NO WARRANTY

The data is expressly provided as is. The Ethics Commission does not amend the data provided by third parties to edit or correct variations in spelling, punctuation, use of abbreviations, redundancies, or inaccuracies. Therefore, the data may not be completely accurate or inclusive. The Ethics Commission makes no warranty, representation, or guaranty of any kind, express or implied, as to the content, accuracy, timeliness, completeness, or fitness for any particular purpose or use of the data; and no such warranty may be implied, including but not limited to the implied warranties of merchantability or fitness for any particular purpose.

The data is not intended to constitute advice and should not be used as a substitute for advice from a professional. Users should not act (or refrain from acting) based on information in the data without independently verifying the information and obtaining any necessary professional advice. Users are solely responsible for ensuring the accuracy, currency, and other qualities of any products derived from or actions taken in connection with the data.

NO LIABILITY

The Ethics Commission and the City of Los Angeles disclaim any responsibility or legal liability to users for:

  • Errors, omissions, or inaccuracies in the data, regardless of how caused;
  • Decision made or action taken or not taken by anyone using or relying on the data;
  • Virus or other damage to any computer or device that might occur during or as a result of accessing the Public Data Portal or the data;
  • Other act identified in any disclaimer of liability or indemnification provision; and
  • Damages of any kind, including lost profits, lost savings, or any other incidental or consequential damages relating to the providing or the use of the data.

The Ethics Commission and the City of Los Angeles expressly disclaim any responsibility to defend or indemnify users against claims of others based on users copying, reliance, distribution, or other use of the data. Users assume the risk of using the data and have no remedy at law or equity against the Ethics Commission or the City of Los Angeles in case the data is inaccurate, incomplete, or otherwise defective in any way.

NO AUTHORITY

A user has no authority to use the data with the intent or effect of representing an Ethics Commission or City of Los Angeles function, product, or opinion. A user has no authority to represent its products or services as though the user were an Ethics Commission or City of Los Angeles agent, employee, or office. User-generated content (including but not limited to reports, charts, databases, applications, and summaries) may not include the Ethics Commission logo, City of Los Angeles seal, or any text or other content suggesting that it is a product of or endorsed by the City of Los Angeles or the Ethics Commission.

DATA CURRENCY

The data may be updated at irregular intervals. Users should check for updates regularly and ensure that the most current version of the data is being used.

DATA AVAILABILITY

The Ethics Commission and the City of Los Angeles are not liable for any modification or suspension of or discontinuation of access to the data.
